Early Access Deposit — Terms & Conditions

01What you are purchasing

Your $999.99 payment purchases the initial HERA FORGE Discovery & Research engagement for the company, brand, organization, or project identified during signup.

This engagement may include research and analysis relating to your:

• Company, brand, products, or services
• Existing digital presence
• Market and industry
• Competitors and comparative positioning
• Target customers and audiences
• Current messaging and positioning
• Existing marketing channels
• Social and digital visibility
• Competitive environment
• Attention opportunities within your category
• Potential applications of HERA FORGE systems, technology, strategy, automation, and AI-enabled marketing

The purpose of this phase is to allow HERA FORGE to understand your company and identify potential strategic opportunities before determining what additional systems, campaigns, technologies, or services may be appropriate.

The $999.99 payment is specifically for Discovery & Research.

It is not payment for a completed advertising campaign, guaranteed platform deployment, guaranteed content production, media placement, software development, campaign management, or any particular commercial result.

02What happens after payment

After payment is successfully submitted, your company will be entered into the HERA FORGE Discovery & Research queue.

Within approximately 48 hours, HERA FORGE intends to contact you using the information provided during signup with an onboarding update that may include:

• Confirmation that your company has entered the queue;
• Your approximate position or expected timing within the onboarding process;
• An estimated date or timeframe for your Zoom consultation;
• Initial questions relating to your company;
• Requests for additional information; and
• Other onboarding instructions where applicable.

The approximately 48-hour period applies to our intended initial onboarding communication.

It does not mean that your research, consultation, recommendations, or any other deliverable will necessarily be completed within 48 hours.

Consultation timing depends on your position in the queue, current demand, team availability, research requirements, and the complexity of your business.

Any date or timeframe provided is an estimate and may reasonably change.

03Discovery & Research

HERA FORGE may begin researching your company using publicly available information after payment has been submitted.

Research may include publicly accessible:

• Websites
• Social media profiles
• Search results
• Advertisements
• Competitor activity
• Industry information
• Public business records
• Media coverage
• Publicly available market information
• Brand positioning
• Customer-facing materials
• Digital visibility
• Content activity
• Other information we reasonably determine to be relevant

We may also request information directly from you.

HERA FORGE determines the scope, depth, methodology, sources, technologies, AI systems, analytical processes, and tools used during Discovery & Research.

Every company is different. Accordingly, the exact research process, depth of analysis, findings, and recommendations may vary substantially between engagements.

04Your HERA FORGE consultation

Following the applicable Discovery & Research phase, HERA FORGE expects to conduct a Zoom consultation with you or your designated representatives.

The consultation is intended to discuss our research, observations, potential opportunities, your business objectives, and ways HERA FORGE may potentially work with your company.

Depending on the business, the discussion may include:

• Brand positioning
• Audience strategy
• Competitive strategy
• Content and distribution
• AI-enabled marketing
• Attention systems
• Marketing automation
• Campaign concepts
• Platform capabilities
• Technology integrations
• Customer acquisition opportunities
• Strategic recommendations
• Potential future HERA FORGE services

The exact scope and depth of the consultation will depend upon the company, information available, research performed, and opportunities identified.

The Discovery & Research engagement does not obligate either HERA FORGE or the customer to enter into any additional engagement.

Any implementation, ongoing marketing, advertising, campaign management, content production, media spending, technology development, platform subscription, software integration, consulting, or other services may require separate pricing, scopes of work, agreements, or terms.

05Deliverables

The primary services purchased through the $999.99 Early-Access Deposit are:

Company-specific Discovery & Research and the resulting HERA FORGE strategic consultation.

HERA FORGE may communicate findings through one or more formats, including:

• Zoom consultation
• Research observations
• Strategic recommendations
• Opportunity assessments
• Preliminary concepts
• Research summaries
• Presentations
• Documents
• Screens or dashboards
• Platform demonstrations
• Other materials or communications

The format and amount of material provided may vary by engagement.

Unless specifically agreed in writing, the $999.99 engagement does not guarantee delivery of a specific number of:

• Pages
• Reports
• Advertisements
• Campaigns
• Videos
• Social posts
• Creatives
• Designs
• Software features
• Strategies
• Concepts
• Leads
• Impressions
• Views
• Customers
• Or other individual work products or results.

06Early access

Customers completing the Early-Access Deposit may receive consideration for early access to HERA FORGE products, systems, technology, features, services, or onboarding opportunities before broader public availability.

HERA FORGE is actively developing and evolving its systems.

Features, functionality, integrations, user interfaces, capabilities, launch dates, access procedures, services, and technology may therefore change at any time.

Participation in the Early-Access program does not guarantee that any specific feature, product, technology, integration, or service will be made available by any particular date.

07All sales are final

The $999.99 Early-Access Deposit is non-refundable once payment has been submitted, except where otherwise required by applicable law.

Your payment authorizes HERA FORGE to reserve capacity, place your organization into our research queue, begin company-specific review and analysis, and allocate internal resources to your engagement.

Because Discovery & Research is individualized to your company, work may begin before HERA FORGE directly contacts you or before your Zoom consultation occurs.

A refund will not ordinarily be issued because you:

• Change your mind;
• Decide not to proceed;
• Fail to attend a scheduled consultation;
• Fail to respond to communications;
• Do not provide requested information;
• Choose not to purchase additional services;
• Disagree with our findings;
• Disagree with a recommendation;
• Experience changed business circumstances;
• Decide HERA FORGE is not the right fit;
• No longer wish to participate in Early Access; or
• Do not obtain the business or marketing result you expected.

08Right to refuse, suspend, or terminate services

HERA FORGE reserves the right, in its sole and reasonable discretion, to refuse, suspend, limit, discontinue, or terminate services to any individual, business, organization, project, campaign, or account.

Nothing in these Terms requires HERA FORGE to accept or continue an engagement that HERA FORGE determines is inappropriate, unlawful, unsafe, deceptive, abusive, inconsistent with our standards, or likely to expose HERA FORGE or others to unreasonable legal, regulatory, reputational, technological, financial, or operational risk.

HERA FORGE will not knowingly provide services that are intended to facilitate, promote, conceal, support, or materially enable illegal or illicit activity.

Without limiting the foregoing, HERA FORGE may decline or terminate an engagement involving or reasonably suspected of involving:

• Fraud, scams, deceptive marketing, or false, misleading, or unsubstantiated claims about products, services, results, or endorsements;
• Goods, services, or content that are illegal, or that are restricted or prohibited by applicable law, payment networks, or the platforms on which we operate;
• Money laundering, sanctions evasion, tax evasion, or other financial crime;
• Infringement or misappropriation of trademarks, copyrights, likenesses, trade secrets, or other rights of any third party;
• Impersonation of any person, business, or organization, or misrepresentation of an affiliation, endorsement, or credential;
• Manipulation of platforms, audiences, reviews, engagement metrics, or advertising systems in breach of applicable law or platform rules;
• Harassment, threats, discrimination, exploitation, or content that incites or promotes harm against any person or group;
• Concealment of the identity, ownership, or true nature of a business or its activities;
• Material misrepresentation of your company, its products, its ownership, or its circumstances, including information provided to HERA FORGE during signup or onboarding; or
• Any other activity that would reasonably expose HERA FORGE, its personnel, its partners, or its customers to legal, regulatory, reputational, or financial harm.

HERA FORGE may also decline or discontinue an engagement for ordinary business reasons, including capacity constraints, a conflict of interest with an existing client, or a determination that HERA FORGE is not the right fit for your objectives.

Where HERA FORGE suspends or terminates an engagement for the reasons described above, or because information you provided proves materially inaccurate, HERA FORGE may retain the Early-Access Deposit to the extent of work already performed and is not obliged to deliver any further work product.

Where HERA FORGE declines to proceed for reasons unrelated to your conduct — such as capacity or a conflict of interest — and before substantive Discovery & Research has begun, the Early-Access Deposit will ordinarily be refunded.

Nothing in this section limits any other right or remedy available to HERA FORGE, and a decision not to exercise these rights on one occasion does not waive them on another.

09Confidentiality and your information

Information you share about your business is treated as confidential and used to research your company and prepare your consultation.

Findings and recommendations prepared for you are yours to use. HERA FORGE retains the right to reuse the general methods, frameworks, tools, and non-identifying insights developed in the course of the work.

Payment is processed by Stripe. HERA FORGE does not receive or store your card details. Our handling of personal information is described in our Privacy Policy.

10Position in line

Waitlist positions are held in the order signups arrive. Joining the waitlist costs nothing.

The Early-Access Deposit commissions the Discovery & Research engagement and places your organization into the onboarding queue. It does not alter the order in which waitlist positions were recorded.

11No guaranteed outcome

HERA FORGE provides research, analysis, strategy, and recommendations. We do not guarantee any particular commercial outcome — including reach, revenue, engagement, virality, rankings, or customer acquisition.

Marketing results depend on execution, market conditions, platform behaviour, and other factors outside our control.

To the fullest extent permitted by law, HERA FORGE’s total liability arising out of or relating to this purchase is limited to the amount you paid.
